Chaitons, Miller Thomson appear in three commercial list suits this past week

Bennett Jones, Chaitons, Dickinson Wright, Fasken, Goodmans, Lenczner Slaght, McCarthy Tétrault, Miller Thomson, and NRF made appearances in multiple commercial list matters before the Ontario Superior Court of Justice last week.

The week’s most notable commercial suit was the $333,309,379.73 case Romspen Investment Corporation v Woodbine Mall Holdings Inc. et al. Dickinson Wright LLP partner David Preger advised applicant Romspen Investment Corporation.

Oleg Roslak, a civil and commercial lawyer at Himelfarb Proszanski LLP, acted for Woodbine Mall Holdings Inc. and five other respondents. Darryl Singer, head of the commercial and civil litigation group of Diamond and Diamond Personal Injury Lawyers, advised respondent Y. Boltyansky. Fasken Martineau DuMoulin LLP partner Stuart Brotman acted for respondent First Commercial Bank. Lenczner Slaght partner Lawrence Thacker advised respondent Niceforo Enterprises Inc.

The next most notable commercial suit was the $202-million case Cerieco Canada Corp. v Mizrahi et al. Babin Bessner Spry LLP partner Cynthia Spry acted for plaintiff Cerieco Canada Corp. Her practice covers class actions, shareholder disputes, competition law, and contractual and securities litigation. Goodmans LLP partner Mark Dunn acted for Mizrahi Development Group (The One) Inc. and two other defendants. S. Mizrahi and 10 other defendants appeared to be unrepresented.

A third notable commercial suit was the $111-million case Kassam v Stafford et al. Bennett Jones LLP partner Robert Staley advised plaintiff M. Kassam. Blaney McMurtry LLP partner John Polyzogopoulos acted for Anson Advisors Inc. and two other respondents. He practises in areas including corporate and commercial litigation.

Won J. Kim, principal at Kim Spencer McPhee Barristers PC, advised J. Stafford and two other defendants. He deals with cases involving securities, shareholder remedies, and complex contractual remedies. A. Rudensky and five other defendants appeared to be unrepresented.

Chaitons LLP appeared in three cases last week

Danish Afroz, partner, represented plaintiff Royal Bank of Canada in Royal Bank of Canada v Maxx Properties (No. 323) Ltd. et al. He assists clients in all aspects of corporate restructuring and commercial insolvency matters.

Harvey Chaiton, partner, advised applicant Roynat Inc. in Roynat Inc. v 2854821 Ontario Inc. et al. He practises in the areas of bankruptcy and insolvency.

Maya Poliak, partner, acted for applicant TDB Restructuring Limited in a case of the same name. Her areas of experience span litigation, bankruptcy, and insolvency.

John Downing, managing partner of the firm’s London office, represented respondent J. Wright in Strauss, on Their Own... et al v Wright et al. He focuses on corporate and commercial disputes, professional negligence, product liability, insurance defence, and real estate.

Tony Van Klink, partner, advised applicant Bank of Montreal in Bank of Montreal v 11603531 Canada Inc. He practises insolvency and restructuring law and related commercial litigation.
