Miller Thomson, Minden Gross, Osler appear in three commercial list suits

Lawyers from Bennett Jones, Diamond and Diamond, Dickinson Wright, Fasken, Himelfarb Proszanski, Kushneryk Morgan, Lenczner Slaght, Ross Nasseri, Stikeman Elliott, and Teplitsky made appearances in multimillion-dollar cases in the Ontario Superior Court of Justice’s Commercial List this week.

The week’s most notable commercial suit was the $333,309,379.73 case Romspen Investment Corporation v Woodbine Mall Holdings Inc. et al. Dickinson Wright LLP partner David Preger represented applicant Romspen Investment Corporation.

Oleg Roslak, a civil and commercial lawyer at Himelfarb Proszanski LLP, advised Woodbine Mall Holdings Inc. and five other respondents. Darryl Singer, head of the commercial and civil litigation group of Diamond and Diamond Personal Injury Lawyers, acted for respondent Y. Boltyansky. Lawrence Thacker, a Lenczner Slaght partner who handles mergers and acquisitions, represented respondent Niceforo Enterprises Inc. Fasken Martineau DuMoulin LLP partner Stuart Brotman advised respondent First Commercial Bank.

The next most notable commercial suit was the $120-million case Nobul Technologies Inc. v Reed et al. Bennett Jones LLP associate Shaan Tolani represented plaintiff Nobul Technologies Inc.

Susan Kushneryk, a Kushneryk Morgan LLP partner who prosecutes securities fraud, acted for A. Jacobs and three other defendants. The six other defendants appeared to be unrepresented. Justin Nasseri, a Ross Nasseri LLP partner who works on commercial and professional liability matters, represented R. McGee and two other defendants to the counterclaim.

A third notable commercial suit was the $20-million case Magnotta Winery Corporation et al v KPMG LLP. David Altshuller, a Teplitsky LLP partner and corporate/commercial litigator, advised Magnotta Winery Corporation and 10 other plaintiffs. Stikeman Elliott LLP partner Patrick O'Kelly acted for defendant KPMG LLP.

Miller Thomson LLP appeared in three cases this week.

James Zibarras, partner, represented defendant Canada Investment Corporation in 2384419 Ontario Inc et al v 1 Plus 12 Corporation et al. He also advised R. Bokhari as an applicant in Bokhari v FSD Pharma Inc. and as a respondent in FSD Pharma Inc. v Bokhari. He has worked on cases involving contractual breach, oppression remedy, and sale of goods.

Minden Gross LLP appeared in three cases this week.

Rachel Moses, partner, acted for Royal Bank of Canada as a plaintiff in the cases of Royal Bank of Canada v Vellend-Tech Inc. et al and Royal Bank of Canada v 2379804 Ontario Inc. et al. She focuses on banking and commercial litigation.

A. Irvin Schein, partner, represented Validus Power Corp. and six other respondents in Macquarie Equipment Finance Limited v Validus Power Corp. et al. He is chairman of the firm's litigation group, a member of its executive committee, and an experienced mediator and arbitrator.

Osler, Hoskin & Harcourt LLP appeared in three cases this week.

Lauren Tomasich, partner, advised applicant Kii Naturals Inc. in Kii Naturals Inc. v Poppy Industries Canada Inc.; acted for respondent PricewaterhouseCoopers LLP in Cunix et al v Sol Global Investments Corp. et al; and represented Syneos Health, LLC and one other applicant in Syneos Health, LLC et al v FSD Pharma Inc. She focuses on commercial arbitration, corporate and securities litigation, and white-collar defence.

Bennett Jones LLP appeared in two cases this week.

Tolani, who worked on the Nobul Technologies case, carries on a general litigation practice focusing on corporate and commercial disputes, securities litigation, and financial crime.

Blake, Cassels & Graydon LLP appeared in two cases this week.

Fasken Martineau DuMoulin LLP appeared in two cases this week.

Brotman, who worked on the Romspen Investment case, leads the firm’s global insolvency and restructuring group.

Peter Mantas, partner, advised 10086207 Canada Ltd and six other defendants in Music Choice (A Pennsylvania General Partnership) et al v 10086207 Canada Ltd et al. He leads the firm’s procurement group and Ottawa litigation team and co-leads its white collar defence and investigations group.
