Dickinson Wright, Himelfarb Proszanski, other firms act in $333-million commercial case

Lawyers from Diamond and Diamond, Dickinson Wright, Fasken, Himelfarb Proszanski, Lenczner Slaght, Bennett Jones, and Fogler, Rubinoff appeared in multimillion-dollar cases in the Ontario Superior Court of Justice’s Commercial List this week.

The week’s most notable commercial suit was the $333,309,379.73 case Romspen Investment Corporation v Woodbine Mall Holdings Inc. et al. Dickinson Wright LLP partner David Preger, who deals with court-supervised real estate workouts, represented applicant Romspen Investment Corporation.

Oleg Roslak, a civil and commercial lawyer at Himelfarb Proszanski LLP, advised Woodbine Mall Holdings Inc. and five other respondents. Darryl Singer, head of the commercial and civil litigation group of Diamond and Diamond Personal Injury Lawyers, acted for respondent Y. Boltyansky.

Stuart Brotman, partner and chairperson of the global insolvency and restructuring group at Fasken Martineau DuMoulin LLP, advised respondent First Commercial Bank. Lenczner Slaght partner Lawrence Thacker acted for respondent Niceforo Enterprises Inc.

The next most notable commercial suit was the $16.1-million case 7539088 Canada Inc. et al v Slattery et al. Bennett Jones LLP partner Nathan Shaheen advised 7539088 Canada Inc. and one other plaintiff. Fogler, Rubinoff LLP partner Milton Davis acted for M. Slattery and two other defendants. P. Miller and three other defendants appeared to be unrepresented.

Chaitons LLP appeared in five cases this week.

Harvey Chaiton, a partner practising bankruptcy and insolvency law, represented applicant Canadian Western Bank in Canadian Western Bank v 1000179473 Ontario Inc. et al; advised applicant Marshallzehr Group Inc. in Marshallzehr Group Inc., as Administrator v 12252856 Canada Inc.; and acted for C.
