Federal Court, Federal Court of Appeal roundup: who's in court

A class action involving disability benefits administered by Veterans Affairs Canada is among the cases before the Federal Court his week, while Federal Court of Appeal has been hearing a claim from several airline companies and associations against the Canadian Transport Agency.

Several law firms acted for the plaintiffs in an ongoing class action involving disability pension, disability award, and other benefits administered by the Veterans Affairs Canada. The lawyers for the classes include Gowling WLG LLP, Michel Drapeau Law Office, Murphy Battista LLP, Koskie Minsky LLP, and McInnes Cooper.

Blake, Cassels & Graydon LLP acted for Janssen Inc. in an action under the new Patented Medicines (Notice of Compliance) Regulations against JAMP Pharma, which was represented by Sprigings Intellectual Property Law.

JAMP Pharma was also involved in another action concerning patented medicines filed by Celgene Inc. In that case, JAMP Pharma was represented by Blaney McMurtry LLP, and Celgene Inc. was represented by Smart & Biggar.

Osler, Hoskin & Harcourt LLP appeared before the federal court on behalf of LJC Apparel in a trademark infringement action against a Quebec-based corporation represented by Dupuis Paquin Lawyers. Osler also appeared in another intellectual property action to represent the defendant, Teva Canada. The action was filed by Novartis Pharmaceuticals, represented by Gowling WLG (Canada) LLP.

Gowling WLG also appeared on behalf of the plaintiff, GE Renewable Energy Canada Inc. in a copyright infringement action against Canmec Industrial Inc, represented by MLS Legal.

Goodmans LLP represented Google in an ongoing patent infringement action against Sonos Inc, which was represented by Smart & Biggar. Goodmans also represented Apotex Inc. in an action involving access to information against the Minister of Health and several others, as well as in an action involving patented medicines against Lundbeck Canada, Inc. which was represented by Gowling WLG.

Gardiner Roberts LLP acted for The Toronto Regional Real Estate Board in a copyright infringement action against IMS Incorporated, represented by Cassels Brock & Blackwell LLP.

Norton Rose Fulbright represented the defendant Bosa Kingswood Properties in an admiralty action involving spillage and pollution filed by the Administrator of the Ship-Source Oil Pollution Fund, represented by Alexander Holburn Beaudin + Lang LLP.

Miller Law acted for Optimal Air Solutions Inc. and Sutherland Law represented Optimal Mechanical Contractors LTD in an action involving a trademark passing off.

Riches, McKenzie & Herbert LLP acted for Masontops Inc. in patent infringement action against Northern Tool & Equipment Company, Inc., represented by Sprigings Intellectual Property Law.

Pinto Legal represented Visionwall International Inc. in a trademark infringement lawsuit against Litezone Technologies Inc., represented by Parlee McLaws LLP

Borden Ladner Gervais LLP acted for the defendant Le Navire Seapace in a case involving personal injury action and loss of life.

MLT Aikins LLP represented Muskeg Lake Cree Nation in an action filed by Alvin Arcand, a former candidate who was seeking to reverse the First Nation’s last election. Arcand was represented by Parlee McLaws LLP.

In another First Nation case, Poulus Ensom LLP and MLG Law represented the individual defendants against an unrepresented plaintiff. Dubuc Osland appeared in a different First Nation case representing Louis Bull Band and several others.

Federal Court of Appeal

Norton Rose Fulbright and Paterson MacDougall represented the plaintiffs in an action filed by several airline companies and associations against the Canadian Transport Agency.

Norton Rose Fulbright LLP represented Fibrogen Inc. in an intellectual property case against Akebia Therapeutics, Inc., which was represented by McCarthy Tétrault LLP.

McCarthy Tétrault also acted on behalf of BCE Inc. in an action against Quebecor Media Inc. and Groupe TVA Inc., which was represented by Woods S.E.N.C.R.L.

Maurice Law represented Withchekan Lake First Nation in a claim against the Crown.
