With the new limit, the government expects more Albertans to file claims in the Alberta Court of Justice. This court utilizes simplified and cost-effective procedures, making it an attractive option compared to other courts. In addition, the Court of Justice is highly accessible for Albertans as it has 72 court locations spread across the province.
"The government's decision to increase the civil claims limit for the Alberta Court of Justice will give more people the option to resolve disputes quickly and efficiently," minister of justice and attorney general Tyler Shandro commented.
Shandro further said that the increase is particularly beneficial for businesses, as timely dispute resolution can help them focus their resources on their core operations and drive growth. "We recognize the importance of providing businesses and individuals with a justice system that is accessible and efficient, and this measure is a step towards achieving that goal."
Alberta Chambers of Commerce president and CEO Shauna Feth also welcomed the government's decision to increase the civil claims limit to $100,000, stating that the new limit will help level the playing field for small and medium-sized enterprises. These businesses will now be able to seek justice through more cost-effective means.
"We are optimistic this measure will contribute to a more thriving business environment in Alberta, and look forward to continuing our collaboration with the government in enhancing the province's business climate," Feth said.
Recent changes to the Justice Statutes Amendment Act allowed the government to increase the civil claim limit in the Alberta Court of Justice. The Alberta government chose the $100,000 limit after surveying Alberta's three courts, the Law Society of Alberta, Canadian Bar Association - Alberta Branch, Alberta Civil Trial Lawyers, and Legal Aid.
The civil claims limit was last increased to $50,000 from $25,000 in 2014. The new $ 100,000 limit will take effect from August 1.
