On August 13, 2024, BC Tree Fruits Cooperative, a member-owned organization serving Okanagan Valley fruit producers since 1936, obtained CCAA protection on August 13, 2024. The cooperative, which works with approximately 290 local growers to store, market, package, and distribute fruit, faced significant challenges due to adverse weather, low fruit volumes, and competition from Washington State growers. Additionally, an internal dispute over a potential but unrealized sale of non-operational real estate to address a $51 million debt to CIBC exacerbated the situation. The CCAA proceedings aim to facilitate a Sales and Investment Solicitation Process (SISP), with CIBC providing DIP financing. Alvarez & Marsal (A&M) was appointed as the monitor. Norton Rose Fulbright served as counsel for the cooperative, Fasken represented the monitor, and Blakes advised CIBC.
