Case Background:
In Jubilee Gold Exploration Ltd. v. Jeffrey Becker and Patti Michele Becker, the dispute arose over corporate assets—gold bars and silver coins valued at over $400,000—belonging to Jubilee Gold Exploration Ltd. Jeffrey Becker, a director, moved these assets into a personal safety deposit box, to which only he and his wife, Patti Michele Becker, had access. This action prompted concerns from Jubilee’s Board of Directors.
Legal Issues:
The Board questioned Jeffrey Becker's capacity to manage corporate affairs, requesting a capacity assessment. Although Jeffrey and Patti initially agreed, they later refused to undergo the assessment. Patti Michele Becker claimed to hold a valid power of attorney over Jeffrey’s affairs, which conflicted with earlier powers of attorney granted to his children, Jade and Summer Becker. Jubilee sought to regain control of the corporate assets, but the bank refused to act without resolving the dispute over powers of attorney and Jeffrey’s capacity.
Court Decision:
The defendants sought a declaration validating Patti's power of attorney. However, the court dismissed the application due to insufficient notice, the ongoing litigation challenging Jeffrey Becker’s capacity, and the complexity of the issues. Madam Justice Sharma declined to issue any orders based on the evidence presented.
Costs and Award:
There was no monetary award or specific costs mentioned in favor of either party. The court ordered a case planning conference involving all parties to resolve the issues.
