The guidelines required licence holders performing kosher slaughter on a food animal to confirm the animal’s state of unconsciousness before suspending it by testing up to three indicator signs to assess whether the animal was unconscious. The applicant alleged that the guidelines were inoperative and invalid because they unjustifiably infringed the applicants’ freedom of religion under s. 2(a) of the Canadian Charter of Rights and Freedoms and right to equality on the basis of religion under s. 15(1) of the Charter and incorrectly and unreasonably interpreted and applied ss. 143 and 144 of the SFCR.
