- Parties: The applicants were the Georgia Strait Alliance, David Suzuki Foundation, Raincoast Conservation Foundation, and Western Canada Wilderness Committee. The respondents were the Minister of Environment and Climate Change, Attorney General of Canada, and Vancouver Fraser Port Authority.
- Subject Matter: This judicial review application challenged two decisions under the Canadian Environmental Assessment Act, 2012 (CEAA 2012), following an environmental assessment of the Vancouver Fraser Port Authority’s proposed project to build and operate a new marine shipping terminal at Roberts Bank, Delta, BC. One decision found the project’s adverse environmental effects justified in the circumstances, and the other decision established conditions for the project to proceed. The applicants had leave to challenge both decisions through a single judicial review application.
- Ruling: The court ruled in the respondents’ favour and dismissed the application. The court held that the applicants failed to prove either of the challenged decisions unreasonable under the law such that the court’s intervention was warranted. The court disagreed with the applicants’ interpretation of the provisions of the Species at Risk Act, 2002 (SARA) allegedly constraining the CEAA 2012 decision-makers. The court agreed with the respondents that the limited obligations that the SARA imposed on the project’s environmental assessment related to a single decision-maker.
- Date: The hearing was set on June 24, 2024. The court released its decision on Jan. 10, 2025.
- Venue: This was a federal case before the Federal Court.
- Amount: The court ordered the parties to bear their own costs.
