- Parties: The applicant was the Canadian Imperial Bank of Commerce. The respondent was George Kouridakis.

- Subject Matter: The applicant filed an application for judicial review of an adjudicator’s decision on the quantum of damages. In 2021, the court allowed the application and sent back the matter for the adjudicator’s redetermination (Kouridakis v Canadian Imperial Bank of Commerce, 2021 FC 1035). On Jan. 11, 2023, the adjudicator redetermined the quantum and ordered the respondent bank to pay the appellant a total sum of $43,200 in satisfaction of all claims arising from the termination of his employment on June 14, 2016. Both parties applied for judicial review of the adjudicator’s redetermination decision.

- Ruling: The court ruled in the respondent’s favour and dismissed the applicant’s judicial review application in file T-289-23. In file T-289-23, the court struck paragraphs 8–14, 16, 22, and 24–26 of the applicant’s affidavit and exhibits Q-1 to Q-32 in the applicant’s record, based on inadmissibility. The court held that the applicant failed to show that the adjudicator made a reviewable error in his assessment and award of legal fees. The court considered the applicable standard of review of reasonableness and concluded that the parties failed to raise an argument successfully showing that the redetermination decision was unreasonable.

- Date: The hearing was set on Mar. 26, 2024. The court released its decision on Jan. 13, 2025.

- Venue: This was a federal case before the Federal Court.

- Amount: The court ordered the parties to bear their own costs.
