George Kouridakis v. Canadian Imperial Bank of Commerce
George Kouridakis
Law Firm / Organization
Levy, Tsotsis
Canadian Imperial Bank of Commerce

- Parties: The applicant was George Kouridakis. The respondent was the Canadian Imperial Bank of Commerce.

- Subject Matter: The applicant filed an application for judicial review of an adjudicator’s decision on the quantum of damages. In 2021, the court allowed the application and sent back the matter for the adjudicator’s redetermination (Kouridakis v Canadian Imperial Bank of Commerce, 2021 FC 1035). On Jan. 11, 2023, the adjudicator redetermined the quantum and ordered the respondent bank to pay the appellant a total sum of $43,200 in satisfaction of all claims arising from the termination of his employment on June 14, 2016.

- Ruling: The court ruled in the respondent’s favour and dismissed the applicant’s judicial review application in file T-275-23. In file T-275-23, the court struck paragraphs 14, 16, 18, 21, 25, 27–28, 30–31, 34–39, 43–46, 48, 50–51, 53, 55, 57, and 58–62 of the applicant’s affidavit and exhibits Q-1 to Q-30 in the applicant’s record, based on inadmissibility. The court denied the applicant leave to amend his affidavit. The court held that the applicant failed to show that the adjudicator failed to apply the law relating to salary loss, ignored his claim, or made a sufficiently central or significant shortcoming or flaw that would render the redetermination decision unreasonable.

- Date: The hearing was set on Mar. 26, 2024. The court released its decision on Jan. 13, 2025.

- Venue: This was a federal case before the Federal Court.

- Amount: The court ordered the parties to bear their own costs.
