In the case of Bennett v Lopez dated October 16, 2023, the plaintiff, Nina Ashley Bennett, had filed a claim for damages resulting from a motor vehicle accident that occurred on November 10, 2016, at or near the intersection of 152nd Street and 64th Avenue in Surrey, British Columbia. In the accident, Ms. Bennett had been a passenger in a 2007 Chevrolet Suburban driven by Corey Vogel, who had collided with a 2011 Nissan sedan driven by the defendant Jorge Flores Lopez. He had admitted liability for the accident, while the claim against Mr. Vogel had been discontinued on November 7, 2022.
Prior to the accident, Ms. Bennett had had a history of depression and ADHD, for which she had intermittently taken medication. She had worked in various jobs, including a check-cashing business, cleaning, and office administration. She had also experienced a traumatic robbery incident in 2011, leading to post-traumatic stress disorder (PTSD). Additionally, she had sustained previous injuries from a 2012 motor vehicle accident and an incident involving her ex-partner in 2013.
Following the trial, Ms. Bennett had been awarded a total of $1,009,893.37 in damages, broken down into different categories, including $215,000 for non-pecuniary damages, $41,348.24 for loss of past income (adjusted depending on her repayment of CERB funds), $664,399 for future income loss, $65,000 for future care costs, and $24,146.13 for special damages.
