Rovi Guides, Inc. v. Telus Corporation

- Parties: The appellants were Rovi Guides, Inc. and TiVo Solutions Inc. The respondents were Telus Corporation, Telus Communications Inc., Telus Communications Company, and Bell Canada.

- Subject Matter: The appellant filed patent infringement actions against the respondent. The Federal Court dismissed the appellant’s actions and granted the respondents’ counterclaims for declarations of invalidity and non-infringement relating to several claims in the appellant’s Canadian patents nos. 2,339,629; 2,425,482; 2,336,870 (870 Patent); and 2,514,585 (585 Patent) involving interactive television program guide technology. The Federal Court held that all the asserted claims were invalid because they were either anticipated and/or obvious, given the prior art and the common general knowledge of a skilled person.

- Ruling: The appeal court ruled in the respondents’ favour and dismissed the appeal. The appeal court accepted that the Federal Court made errors in many respects of its remedial analysis that required correction. However, the appeal court held that these remedial errors did not affect the appeal’s outcome. The appeal court saw no reviewable errors in the Federal Court’s obviousness analysis regarding the 870 Patent or in its anticipation analysis regarding the 585 Patent. The appeal court found it unnecessary to address its obviousness findings on the 585 Patent.

- Date: The hearing was set on Nov. 29, 2023. The court released its decision on Aug. 6, 2024.

- Venue: This was a federal case before the Federal Court of Appeal.

- Amount: The appeal court awarded costs in an unspecified amount.
