In November 2015, Wokun (Kirt) Zhao entered into a contract to purchase a property in Surrey, Canada, from Amrik Purewal and Jisbinder Purewal for $2,780,000. Shortly after, the Purewals expressed their desire to back out of the deal. The legal implications of their attempts to terminate the contract and whether Zhao successfully maintained its enforceability became the central issue. When the closing date arrived, Zhao sent the Purewals the purchase price and closing documents, but they didn't respond or convey the property. Zhao then purchased an alternative home due to rising house prices and budget constraints, which led him to abandon his original criteria. Zhao argued that the contract allowed him to have the property conveyed to him, a right he claimed to have given up on July 19, 2016, and sought damages based on the difference between the purchase price and the property's market value on either that date or the original closing date of March 28, 2016. Ultimately, the court found the Purewals in breach of contract for failing to convey the property. Zhao was awarded $326,875 in expectation damages based on an appraisal of the property's value as of March 28, 2016. Pre-judgment interest was also granted from that date. The parties had the option to request a further hearing on the issue of costs or costs would follow the event.
