In the case of Duninger Corporation v. Montour, dated September 12, 2023, the dispute had its origins in a planned cannabis grow operation within the Pit River Tribe's territory in California. The plaintiff, Duninger Corporation, had been engaged to provide consulting services and oversee electrical work for the greenhouses at the facility. However, the situation took a downturn when American federal authorities executed a search warrant and initiated a criminal investigation, resulting in significant losses for all parties involved. The central issue revolved around the defendant's role in the project and subsequent liability. Jerry Montour, the defendant, who was located in Ontario, had no formal written contract with the plaintiff and never interacted with them directly. Instead, the plaintiff primarily dealt with Rami Reda, who acted as the de facto project manager on-site. Nevertheless, it was acknowledged that the defendant had been the ultimate source of funds until payments came to a halt. The plaintiff had also filed a lawsuit against Mr. Reda but reached a settlement with him and his company, Big Bee Corporation. Ultimately, the court ruled in favor of the plaintiff, holding the defendant liable for $274,103 in outstanding work and $184,266.29 for materials and services, along with interest at 18% per annum. The parties were instructed to reach an agreement on costs or submit brief submissions.
