The case of Jaura v Rosal had arisen from a motor vehicle collision on May 4, 2018, at the intersection of Inverness Street and 49th Avenue in Vancouver. The intersection had traffic lights on 49th and stop signs on Inverness, along with pedestrian controls. The plaintiff, Rita Jaura, a 62-year-old woman with a background in jewelry and aircraft grooming, had sustained injuries due to the collision.
Rita Jaura, who had been proceeding northbound on Inverness, had stopped at the intersection and proceeded when she had seen the pedestrian signal. Her vehicle was hit on the passenger side, causing it to roll and come to rest on its roof. The defendant driver, Nikolai Arcilla, had claimed to have had the green light and struck Jaura's vehicle as it had moved into the intersection. A video had shown the defendant's van slightly into the intersection.
The injuries sustained by Rita Jaura had affected her physical abilities and daily tasks, including housekeeping and work. The court had awarded her non-pecuniary damages of $110,000, a past earning capacity loss of $90,652, a future earning capacity loss of $35,000, future care costs of $40,000, and special damages of $58,585.05. As a result, the total awarded had been $334,237.05.
