Kandlproperties Inc. v. George Street Law, et al.
The case of Kandlproperties Inc. v. George Street Law, et al., which was dated March 3, 2023, involved a summary judgment previously granted by a judge in the case of plaintiff Kandlproperties Inc. against defendant Big Bang Consulting Inc. concerning a failed real estate transaction that had arisen from a purchase agreement. The judge had declined the enforcement of specific performance but had ruled in favor of Kandlproperties for $120,920.00, coupled with pre- and post-judgment interest. Following this, in June 2022, Kandlproperties had initiated a writ of seizure and sale in the Middlesex County. Nonetheless, the Sheriff's office had indicated that the sale of the property couldn't proceed within six months from the issuance of the writ, thereby causing a delay in the enforcement.
In September 2022, Big Bang had transferred the property in question to Gramercy Park Holdings for $1,092,000.00, without providing prior notification to Kandlproperties. This transfer had triggered a legal dispute, leading Kandlproperties to seek an interim court order to prevent the encumbrance of the property, assert the continued validity of their writ, and impose restrictions on the property's title.
However, the judge dismissed the motion put forth by Kandlproperties, suggesting that alternative avenues were available for enforcing the judgment against Big Bang. The judge had emphasized that Gramercy, an innocent third-party purchaser, should not face adverse consequences due to a writ that had not been in place at the time of the property acquisition. The decision had not conveyed any form of endorsement or criticism toward the actions of any of the parties involved, and the matter of costs remained pending resolution.
