In the case of Schwab Estate v Warriner dated February 14, 2023, two children had lost their father to a fentanyl overdose in 2018. The dispute had arisen over the distribution of the father's estate because he had no will. Kimberlea Dawn Masters, the mother of the said children had been granted administration of the estate and had been the plaintiff in the case. On the other hand, the deceased partner, whose name was Diana Warriner, had been the defendant in this case, claiming to be his spouse and wanting control. The court had determined that their relationship did not qualify as a marriage-like one. There had also been a $350,000 transfer before his death, which the plaintiff had argued should benefit the children. The court had agreed and had ruled that they were not spouses, awarding Mr. Schwab’s estate $350,000 in damages and $50,000 in punitive damages against Ms. Warriner.
