On June 16, 2017, plaintiff D.J.W., a 12-year-old boy, was injured in a car accident. It is not disputed that the plaintiff and his mother were driving when a car abruptly slowed down without signaling, causing the mother to brake and be rear-ended. He complained of neck pain and was taken to BC Children's Hospital instead of Surrey Memorial due to concerns. X-rays showed no concerns, and the diagnosis included a concussion and motor vehicle collision. He was advised to follow concussion guidelines and see Dr. Korn. Mother's injuries were addressed separately at Vancouver General Hospital. Liability has been accepted by the defendant, Amitabh Biswal. The trial focused on determining the extent of the boy's injuries and assessing damages. The court awarded the plaintiff the following amount: a) Non-pecuniary damages of $215,000.00; b) Loss of housekeeping capacity of $31,000; c) Future loss of earning capacity of $700,000; d) Cost of future care of $21,709; and e) Special damages of $8,333.90. Total of $976,042.9
