In the case of Toy v. 0954516 B.C. Ltd., which concerned costs, Mr. Toy, a 61-year-old employee, was terminated by his employer, Vedder, and was granted severance pay. Vedder sought clarification on costs. The court examined whether it could reopen the matter and applied the test for awarding costs. It concluded that it was not functus officio and had the authority to reopen the matter. Subsequently, the court assessed whether there were adequate grounds for Mr. Toy to pursue the case in the Supreme Court instead of the Provincial Small Claims Court. Taking into account factors such as complexity and the necessity for legal representation, the court determined that Mr. Toy had sufficient reason to do so.
