Plaintiff
Defendant
The Plaintiff, who was previously employed by the Bank of Nova Scotia (BNS), initiated a lawsuit against the BNS and the Attorney General of Canada (AGC). The Plaintiff made allegations of negligence, rights breach, and conspiracy against both parties. The claims encompassed the denial of employment rights, systemic negligence, breach of the Charter of Rights and Freedoms, and violations of various laws and regulations. The Plaintiff sought $30 million in damages, including punitive damages, loss of wages, and interest. The Defendants submitted motions to strike the Plaintiff's claims. The costs sought under Rule 334.38 were found to be inapplicable. The Plaintiff's claims were dismissed for failure to establish a reasonable cause of action or jurisdiction. The court struck down the Amended Amended Statement of Claim (AASC) without allowing further amendment. Both the Bank of Nova Scotia (BNS) and the Attorney General of Canada (AGC) were granted costs, with the BNS awarded $3,400 and the AGC awarded $500. The AASC was entirely dismissed, and the actions against the BNS and AGC were terminated.
