The Plaintiff, Worthware Systems International Inc., sought a Norwich Order to compel Mr. Richard Lalancette, the sole director and officer of Raysoft Inc., to provide information about Raysoft's clients in a patent infringement action. Worthware claimed it needed the information to take action against direct infringers of its patent. However, the court dismissed the motion, stating that Worthware failed to establish that Lalancette was the only practical source of the information. The court also considered the prior order refusing disclosure and the timing of the request. It was further ordered that the Plaintiff shall pay to the Defendant the all-inclusive lump sum amount of $5,000.
