Hapag-Lloyd Aktiengesellschaft v. Golden Trust Trading Inc.
Hapag-Lloyd sued Golden Trust Trading Inc. for fees related to the carriage of containers from Vancouver to Bangkok. Golden Trust failed to respond within the time limit, so Hapag-Lloyd sought default judgment. The court granted judgment in favor of Hapag-Lloyd, awarding them $4,060,061.46, plus interest and costs. The containers were not imported into Thailand due to a change in environmental import standards, and Hapag-Lloyd claimed demurrage and other costs. The court reviewed the evidence and concluded that Hapag-Lloyd proved its claim. The judgment amount will be converted to Canadian dollars, and interest will be applied.
