- Parties: The plaintiffs were A.B. and Jean-Pierre Robillard. The defendant was His Majesty the King. 

- Subject Matter: On Dec. 20, 2024, the Federal Court certified this matter as a class proceeding and approved the final settlement agreement (2024 FC 2060). The court defined the class as “All persons who are or who have been enrolled as Canadian Armed Forces (CAF) Members at any time from April 17, 1985, and for any duration up to and including the Approval Date, and who assert that they have been subjected to Racial Discrimination and/or Racial Harassment.” The court approved the final settlement agreement dated June 6, 2024 under r. 334.29 of the Federal Courts Rules, SOR/98-106, upon finding it fair and reasonable and in the best interests of the class. The court appointed Deloitte LLP as claims administrator. The court approved the payments of honoraria under article 14 of the final settlement agreement. 

- Ruling: The parties asked the court to deem the approval date as defined in the final settlement agreement to be Jan. 10, 2025 and not Dec. 20, 2024 so that the notice plan could be timely launched and implemented amid the intervening holiday season. The court granted this request upon noting that the parties consented to it.
