Georgetown Rail Equipment Company v. Tetra Tech Eba Inc.
This was an assessment of costs triggered by a Federal Court order and reasons. The court postponed the determination of costs for the liability phase until the reference on damages or an accounting of profits was completed. The liability trial proceeded alongside the interlocutory appeal, but when the Federal Court of Appeal rendered a new judgment favoring the defendant, costs were to be determined for the defendant rather than the plaintiff. No extra costs were awarded for the remanded hearing. After the hearing concluded, the defendant sought the court's aid in resolving their outstanding costs related to the liability trial.
The Defendant's Bill of Costs is assessed and allowed in the amount of $158,707.95. The Plaintiff, Georgetown Rail Equipment Company, is required to pay this amount to the Defendant, Tetra Tech EBA Inc. A Certificate of Assessment will be issued.
